John Baraniak, partner in litigation, wrote “Group Pleading: Dead or Alive?” published in the American Bar Association’s Securities Litigation Journal. 

The article examines the current state and possible future of the group pleading doctrine and and addresses the following questions:

  • Why have some courts been reluctant to decide whether the group pleading doctrine survives heightened pleading requirements of the Private Securities Litigation Reform Act of 1995?
  • Why have the courts that have tackled the issue come out on different sides?
  • What is the significance of the split among the courts?
