Mike Gass and John Baraniak co-wrote an article featured in Securities Law360.  Their article, "Iqbal's Impact on SEC Enforcement Actions," discusses the Supreme Court decision in Ashcroft v. Iqbal which which strengthened Federal Rules of Civil Procedure 8’s basic pleading standard creating high pleading standards in some SEC circuits.

Gass and Baraniak state, "It is known there are no definitive conclusions that can be drawn from the handful of cases that have grappled with this issue since the Supreme Court handed down its decision last year. Preliminary results, however, suggest that Iqbal may not prove as potent a weapon in the defense arsenal as some may have thought it would."
