  • Hot topics in claims purchasing and trading

Douglas Gooding, chair of Choate’s Finance Group spoke on the panel titled “Troubled Portfolio Companies.”  The panel focused on issues faced by private equity firms when portfolio companies are in serious financial distress, which include:

  • Fiduciary duties
  • Dividend recapitalizations
  • Equitable subordination
  • Recharacterization
