Eric Marandett, along with Gavin Bogle of Choate's client Iovate Health Sciences Inc., co-wrote “Biotechs Face Higher Bar For Induced Infringement" in Intellectual Property Law360.  This article discusses recently established standards that make it harder to prove induced infringement of patents than direct infringement, and how this discrepancy threatens the value of life sciences patents across the industry, since for most biotech and pharmaceutical patents it is impractical to sue direct infringers.
