Kristin Abati and William Lowell wrote "Fixing Crummey Problems" in Trusts & Estates magazine, a wealth management journal for estate planning professionals.  They discuss the recent Turner decision and its role in the ongoing battle over which gifts to trusts are "present interests" that qualify for the annual exclusion from gift tax.  They examine what the courts and the IRS have had to say, as well as what this means for estate planning clients.
