Jack Cinquegrana co-wrote “A Securities Litigator’s Guide to D&O Insurance — Parts I and II” in Securities Law360, in which he discusses what counsel must do to assure that defense, settlement and judgment costs are paid by the client’s insurer.

Part I of the analysis examines coverage issues, including situations in which coverage limits may be exhausted; what events will trigger coverage; and common policy exclusions.

Part II identifies barries to securing payment, including misrepresentation; insurers' approval of counsel and consent to settlements; privilege issues; and bankruptcy.
