Jeffrey Pelligrino draws upon his industry and patent office experience to provide effective, goal-oriented counsel to clients across a broad range of technologies, representing clients in all forms of IP disputes.  Mr. Pelligrino’s sophisticated understanding of the patent application process allows him to focus on translating clients’ business objectives into a targeted legal strategy structured to protect clients’ assets, while also working to secure their IP rights where necessary.

Prior to joining Choate, Mr. Pelligrino worked as a patent examiner at the US Patent & Trademark Office, where he analyzed applications to determine patentability, researched prior art and formulated arguments for patent application appeals.  He also gained valuable industry experience designing, developing and optimizing a radar production test system. 

Practice Focus

Intellectual Property Litigation:  represents both plaintiff patent holders and defendants accused of infringement – with specific emphasis on electrical and computer engineering technologies, including networking, software, control systems and telecommunications.  Conducts non-infringement and invalidity analysis on asserted patents to develop litigation strategy.  Advised client on likelihood of using re-exam to invalidate patent claims.

Intellectual Property:  prepares and prosecutes patent applications, specializing in the areas of electrical and computer engineering technologies.  Counsels clients with regard to patent portfolio strategy; prepares invalidity and non-infringement opinions.

Due Diligence:  conducts IP due diligence reviews and freedom-to-operate analyses.

Representative Engagements

  • Assisted in preparation of patent applications relating to mobile device software.
  • Preparation of non-infringement and invalidity contentions for case involving e-commerce technology.
  • Assisted in representation of private equity fund in purchase of animation company.
  • Assisted in representation of medical device company in patent infringement case.

Professional and Community Involvement

Mr. Pelligrino served as a legal intern with NH Legal Assistance, a non-profit law firm offering legal services to seniors and low-income persons, where he represented clients in housing matters.
