David Max is of Counsel in Choate’s Litigation and Investigations group. He represents clients in connection with complex commercial disputes in federal and state courts, with a focus on securities, antitrust, and other business litigation. David has extensive experience handling high-stakes litigation matters involving contractual disputes, structured finance products, employment issues, bankruptcy matters, and professional malpractice claims. He routinely advises public companies, financial institutions, investment firms, and private businesses across a range of industries, including pharmaceuticals, financial services, media, telecommunications, and energy. David is particularly experienced in complex class actions, multidistrict litigation, and disputes involving antitrust and sophisticated financial products.

  • Represented Teva Pharmaceuticals and Actavis in multidistrict antitrust litigation alleging price-fixing of more than 100 generic drugs.
  • Represented Loreley Financing in claims against major investment banks and financial institutions arising from billions of dollars of collateralized debt obligations and other structured finance products.
  • Represented Comcast Corporation in antitrust class actions brought on behalf of multiple putative consumer classes.
  • Represented the Royal Bank of Canada in successful litigation involving RMBS waterfall provisions.
  • Represented Hudson Solar Cayman in a creditor dispute seeking payment under a guaranty securing approximately $54 million in notes.
  • Represented retail investors in litigation against Humanigen relating to a PIPE transaction involving the company’s proprietary biopharmaceutical product.
  • Represented real estate developer Rotem Rosen in multiple business disputes with a former partner, resulting in favorable dismissals and settlements.
