Diane Seol is Of Counsel in Choate’s Government Enforcement & Compliance Group, where she represents and advises clients in complex and high-stakes internal and government investigations and litigation. Diane draws on her experience as an Assistant United States Attorney in the Affirmative Civil Enforcement unit of the U.S. Attorney’s Office for the District of Massachusetts, where she served for over four years before re-joining Choate in 2026. In her time at the U.S. Attorney’s Office, Diane managed sophisticated False Claims Act and Anti-Kickback Statute investigations and litigations involving major pharmaceutical manufacturers and healthcare providers. She worked closely with whistleblowers, the Civil Frauds section of the Department of Justice, and other federal and state agencies on high-profile matters involving Medicare co-pay assistance practices, drug-price reporting, medically unnecessary services, and other fraud affecting federal payors. Prior to her time at the Department of Justice, Diane was a Principal in Choate’s Intellectual Property Group, where she represented life sciences, pharmaceutical, and technology clients in complex intellectual property litigation and arbitration. Diane also served as a Special Assistant District Attorney in Suffolk County. Representative Engagements Litigated alleged False Claims Act violations against a major pharmaceutical manufacturer involving the use of co-pay assistance foundations, including favorable summary judgement rulings and successful argument of key evidentiary and discovery issues, culminating in a global settlement of $450 million. Investigated and litigated allegations that a pharmaceutical manufacturer engaged in inflated average sales price reporting, including drafting the government complaint and preparing dispositive briefing addressing complex statutory and regulatory issues. Investigated allegations that skilled nursing facility operators provided medically unnecessary services, conducting detailed review of patient medical records to identify indicators of harm and patterns inconsistent with clinical necessity. Represented life science and technology companies in IP litigation involving non-infringement, invalidity, inequitable conduct, and sanctions issues.
