Peter A. Flynn

Peter Flynn helps clients to maximize the value of their IP portfolios by preparing and prosecuting US and PCT patent applications across multiple engineering disciplines with a focus on biomedical engineering, medical devices, drug manufacturing, and food products. His experiences include all aspects of portfolio development including patent drafting, strategy development, and international prosecution. He also performs prior art and infringement analyses, and prepares freedom to practice and invalidity opinions. Peter additionally supports companies during investor and lender IP due diligence efforts. 

Peter has also been actively involved in practice before the Patent Trial and Appeal Board (PTAB).  He has represented Vivasure Medical LLC, Belmont Instrument, LLC, and Octaviant Financial, Inc. in ex parte Appeals, as well as Central Security Group – Nationwide, Inc. in Inter Partes Review (IPR) proceedings.

Previously, Peter worked as an Aerospace Engineer at GE Aviation, leading FAA engine certification campaigns as well as developing analytics for real-time, on-wing engine health monitoring.  Peter also worked both as a Patent Attorney in GE’s in-house patent organization, and as a Patent Leader for GE Aviation, where he worked on strategic initiatives to protect GE’s intellectual property.

  • Foundation Medicine, Inc. v. Guardant Health, Inc., PTAB: Counsel for Foundation Medicine in IPR proceedings challenging patents directed to methods for detecting genetic mutations; identification and assessment of relevant prior art; development of potential grounds of invalidity.
  • Central Security Group - Nationwide, Inc. et al. v. Ubiquitous Connectivity, LP, PTAB: Counsel for Central Security Group in challenging patents related to the use of SMS (short message service) messages and cellular networks to control and monitor environmental devices. Patent Prosecution and Counseling

  • Handled all aspects of patent portfolio development for multi-national industrial company in energy space.
  • Handling development of patent family in mRNA manufacturing space for multi-national pharmaceutical company.
  • Performed diligence of borrower patent portfolio relating to heart valve technology, leading to successful $100M Series C financing on behalf of Bain Capital Life Sciences.
