Diane Seol focuses on complex civil enforcement matters, healthcare-related fraud investigations, and high-stakes government inquiries. She brings significant experience from her service as an Assistant United States Attorney in the Affirmative Civil Enforcement unit of the U.S. Attorney’s Office for the District of Massachusetts, where she handled sophisticated False Claims Act and Anti-Kickback Statute investigations involving major pharmaceutical manufacturers, healthcare providers, and federal healthcare programs. Diane regularly works with whistleblowers, Main Justice, and federal and state agencies on matters involving Medicare co-pay assistance practices, drug-price reporting, medically unnecessary services, and other fraud affecting federal payors. She develops enforcement strategies, manages large multidisciplinary teams, and handles complex evidentiary records in fast-moving, high impact matters. Early in her career at Choate, Diane represented life sciences, pharmaceutical, and technology clients in complex intellectual property litigation, arbitrations, and internal and government investigations. Through her experience with the Suffolk County District Attorney’s Office, she also gained substantial courtroom experience, managing an active criminal docket and trying numerous cases to verdict. Representative Engagements Litigated alleged False Claims Act violations against a major pharmaceutical manufacturer involving the use of co-pay assistance foundations, including favorable summary judgement rulings and successful argument of key evidentiary and discovery issues, culminating in a global settlement of $450 million. Investigated and litigated allegations that a pharmaceutical manufacturer engaged in inflated average sales price reporting, including drafting the government complaint and preparing dispositive briefing addressing complex statutory and regulatory issues. Investigated allegations that skilled nursing facility operators provided medically unnecessary services, conducting detailed review of patient medical records to identify indicators of harm and patterns inconsistent with clinical necessity. Represented life science and technology companies in IP litigation involving non-infringement, invalidity, inequitable conduct, and sanctions issues.
