Trial counsel for reinsurers concerning large property claims and aggregation issues, including with respect to ice dam, wildfire, and storm losses. Litigation counsel for U.S. cedent that successfully recovered over $100M from Asian reinsurer. Trial counsel for leading reinsurer in $75 million arbitration concerning treaty underwriting issues. Obtained $100 million recovery in catastrophe bond dispute. Finance and Bankruptcy Litigation Litigation counsel to DIP lenders in various Chapter 11 cases, including the Rite Aid bankruptcies. Trial counsel for secured lender in contested debtor-in-possession proceedings, including the Tuesday Morning bankruptcy. Represented insurer in $1 billion bankruptcy adversary proceeding. Trial counsel for major technology company in connection with alleged $40 million fraudulent transfer. Successfully defended senior secured bank syndicate from lender liability claims. Obtained summary judgment for investor in lawsuit alleging $25M million investment fraud and breach of fiduciary duty. Successfully defended lender from claims alleging breach of restructuring support agreement.
